Who you are agreeing with
Gemburrow is published by HyperSage AI Labs LLC, a Delaware limited liability company ("we", "us"). By downloading or using the game or this website you accept these terms. If you do not accept them, please do not use the game.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Gemburrow on devices you own or control, for your own non-commercial use. The game, its art, its music, its code and its name remain ours.
You may not:
- copy, sell, rent, sublicense or redistribute the game or its assets;
- reverse-engineer, decompile or modify it, except where that right cannot lawfully be excluded;
- use automated tools, modified builds or altered saves to place scores on the Daily Dig leaderboard;
- use our name, icon or artwork to suggest that we endorse something we do not.
Streaming, recording and writing about the game is welcome and needs no permission from us.
Coins, hoards and other imaginary property
Coins, dig walls, career stars and the dragon's hoard are game state stored on your device. They have no monetary value, cannot be bought, sold, transferred or exchanged for anything, and we make no promise that any of them will continue to exist in a future version. None of them can be bought with real money.
Gemburrow does have one in-app purchase: The Full Burrow, a single one-time unlock that opens career levels 11–40 and the 14-day dig archive. Like the game itself it is licensed to you, not sold, and it buys content only — it never changes swings, satchel slots or what is in the jar, so it cannot give anyone an advantage on the Daily Dig. The sale is Apple's: they take the payment and they handle refunds, so a billing or refund question goes to Apple rather than to us. To put the unlock back on a device you already bought it on, use the Restore Purchase button described on our support page.
The Daily Dig leaderboard
The leaderboard is a courtesy, not a contract. Names on it are generated by the game and cannot be chosen. We may remove any score, reset a day, or take the board down entirely — for example where a score is implausible for the day's jar, or where the board is being abused. We do not guarantee that it will be available at any particular time.
Privacy
What the game stores and the one thing it sends are described in the Privacy Policy, which forms part of these terms.
Availability and changes
We may update, change or discontinue Gemburrow or any of its features. We may also update these terms; the date at the top will move, and continuing to play after a change means you accept the revised terms.
No warranty
Gemburrow is provided "as is", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the game will be uninterrupted, error-free, or that your progress will never be lost.
Limitation of liability
To the maximum extent permitted by law, HyperSage AI Labs LLC will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data or lost game progress, arising out of your use of Gemburrow. Where liability cannot be excluded, it is limited to the amount you paid us for the game, which is zero. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Apple
Gemburrow will be distributed through the App Store. Apple is not a party to these terms, has no obligation to provide support for the game, and is not responsible for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the App Store is also governed by Apple's own terms.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the courts of Delaware will have jurisdiction — except where the law of your country of residence gives you the right to bring a claim locally, in which case that right is unaffected.
